Main Body

The National Commission for Backward Classes was constituted as a statutory body after Mandal case study court in 1998. Later it was accorded the status of a constitutional body, under Article 338 B. Examining constitutional & legal safeguards for SEBC: Functions of NCBCDispute resolution and inquiries into complaintsParticipation in socio-economic policy making etc. Role of National Commission for Backward Classes 1) Accorded the same status to SEBC, as scheduled castes and scheduled tribesconstitutional backing. 2) Earlier, it only had the power of inclusion and exclusion of castes, now it can participate in socio-economic development.
3More than 50,000 complaints of SEBC were pending with National commission for scheduled castes → NCBC provides speedy dispute resolution. 4) Can provide recommendations and evaluate working of safeguards → proposed reservation for SEBC under Article 16. Lacunae 1) Recommendations are non-binding 2) EML, 29% advocates are rejected against socially & educationally backward classes. 3) delays in taking of reports. Eg: according to RTI, reports have been declining in last 20 years. Way Forward 1) Recommendations should be binding 2) Specify grievance redressal mechanisms to swifter functioning of various schemes for SEBC 3) Audit mechanisms to evaluate functioning of various schemes for SEBC 4) Appointment of members of NCBC should be transparent and accountable, in order to ensure intra-generational equity strengthening of NCBC is vital for InaJ@TS.
