The 69th Constitutional Amendment Act introduced the system of dual governance in India between the popularly elected Chief Minister and the Lieutenant Governor LG appointed by the Union. Dual Governance Dilemma (1) The 69th CAA along with future amendments made the LG rather powerful: ○ Government could mean the LG. ○ LG can take decisions on state subject matters like public order. (2) Clash between popularly elected government M (the people's mandate) and the Union appointed (i.e. the LG)LG can overhadow CM's decisions.
Impact on Cooperative Federalism Unfortunately, the impact has been that of contested federalismthose between centre & stateconcerns of central supremacyreduced state autonomygovernment in name only as LG holds subset of powers. eg: recently, the Chief Minister appointed in Delhi, power to come under LG's direction. Thus, instead of electing cooperative federalism, the 69th CAA has become a political bone. Hence there is need to apply committee recommend about: 1) Rajmannan Committee & Governs (and LGs) should not be agents of the centre but should follow constitutional responsibility as head of State. 2) SCCC advice can be taken for appointment of Governor/LG, need to ensure political[illegible]. Role of LG should be to facilitate state governance and not become an obstacle. Adre corporation of Civil and Grants can ensure this coded to be reached.
