Representation of People Act (1951) provides various provisions like Qualification Disqualifications, seats in parliament etc thus providing clear idea about the election process. What are the ambiguities? (1) Election Commission's discretion to MP can approach to ECs under section 11 of RPA,1951. Discretion to remove disqualification (2) Ambiguous terms and not clearly defined. Case of defamation could have been given a sentence of less than 2 year. However RPA,1951 has also highlighted other clear grounds for disqualification which helps in strengthening democracy. Corrupt practices (sec 123) present promoting conflict among people affecting to assure identities. This RPA,1951 is an important act guiding towards achieving union of free & fair elections.
