Discuss the role of the NCBC in the wake of its transformation from a statutory body to a Constitutional body. Before 2018, NCBC was a statutory body. In 2018, through 102nd Constitutional Amendment act, Article 338B was added which provided Constitutional Status to NCBC. Role of NCBC: ⟶ Take measures: for welfare of socially and educationally backward classes. ⟶ Enquire: site the complaints given by people of SBCs. ⟶ Implementation: monitors the proper implementation of Constitutional and legal rights of SBCs. ⟶ Recommend: Inclusion & exclusion of community in SBC list. ⟶ Civil Court: It has powers of civil court while examining witnesses & conducting investigating. Can summon witnesses. Ask for documents.
Limitations: ⟶ NCBC is only advisory & can not enforce its codes. ⟶ Irregular submission of reports to President ⟶ Advises often ignored by govt. ⟶ Lack of infrastructure & staff ⟶ Lack of funds. Way Forward: ⟶ More powers should be given to NCBC ⟶ 2nd ARC: Set up online channels & increase awareness. ⟶ Improve infrastructure ⟶ NCBC along with NLSC & NCST can be the bulwark of human rights of people historically discriminated. ⟶ It should be strengthened to function properly.
