The legislation has indeed several shortfalls due to various issues: (1) Sexual activity with children (below 18 yrs) is crime. But evolving social conditions has led to consent of child involved. (2) Lack of female personnel at police station, leading to mental harassment of female victim.

(4) Issues of child pornography and child sexual abuse material CSAM (5) Social awareness lagging due to apathy towards marginalised community. However, there is always a scope of improvement: (1) Strengthening reporting mechanism via awareness. (2) More female police officers for empathy. (3) Special POCSO court for victims.
