The National Green Tribunal (NGT) is established to dispense with the cases of violation of some laws mentioned in the schedule of NGT Act. Ex: Environment Protection Act, Water Act, etc.
Main Body
The urgency and importance of regulating sustainable development keeps NGT at the centre of environmental compliance. Contribution: Suspension of permitting to POSCO, South Korean steel company. Act of Living Fettered in Yamuna version 3 penalised. Interim ban on plastic bags of < 50 micron size.
Recommandatory body not equipped with enforcing rulings. The time limit to report to NGT acts in an opposite way to the benefits. Short tenure of members. Political executive interference on Appointed by Central Govt with CSI's advice. The appealing from NGT just in crease the pendency in higher courts (HC, SC). Lack of experts & inability to balance between Economy & Environment. Hence in NGT to truly safeguard environmentally sustainable development: Financial autonomy (charged on CFY), Access to expert groups, Time bound actions; more powers regarding implementation of decision is needed.
