The Protection of Children from Sexual Offences (POCSO) Act, 2012 falls short of achieving its intended objectives. Comment.
Main Body
POCSO Act 2012 was enacted to protect children from sexual offence and abuses, ensuring basic right of children. Objectives of POCSO Act, 2012: - Definition to sexual act - Punishment strict criteria - Non Maintaining dignity of victim - Strict timeline for investigation. POCSO Act fell short in following ways: (1) The intended objectives of strict timelines are violated by police. (2) Lack of Police's proactivenes to file case timely FTP.
Fear of outracidalitization, atypical victim justice to register case. POCSO Act does not cover online sexual abuse, digital rappes etc. Amendly POCSO Act, while reflecting present realities and enforcing accountability will go long way to achieve its objectives and protect child right.
