The 'third gender' has not yet been engendered in the Indian society despite legislative nudge. Analyse.
Main Body
Rights of Transgenders Act was passed in 2014. It delineated the rights of transgenders. Also, in SC has in its pronouncements placed transgenders at parity with other citizens ensuring that they have equal access to rights enshrined in the Indian Constitution. However, third gender have been engendered in the following way: (1) Large scale discrimination in job and labour markets (2) Social stigma associated with them (3) Third gender suffer from psychological distress due to such isolation (4) No other option than to live within close groups leading to 'ghettoization' (5) Outspoken ridicule against them leads them to hide their identity causing identity crisis
Thus, following measures are required: - Remove stigmatization using Constitutional protection by positive campaigns against publication of social discrimination on lines of Article 17 - Authenticity Steps like 'all-transgender operated restaurants', 'reservation' in jobs etc are steps in right direction for engendering the 'third gender'
Conclusion
Steps like 'all-transgender operated restaurants', 'reservation' in jobs etc are steps in right direction for engendering the 'third gender'
