National Emergency under (Art 352) is proclaimed in case of war, external aggression or armed conflict by President of India.

Conditions for proclamation of National Emergency:

In case of armed conflict in the country
War
External aggression
By president under Art 352 through written recommendation of cabinet (as per 44th amendment Act 1978)

Consequences of proclamation:

1. Unitary nature - country become unitary from federal

Center gains excessive power on states

State government under complete central control (not suspended)

Parliament - can make laws on State list
President can reduce earned transfer of finances from center to state
Life of Lok Sabha could be extended by one year at a time

Art 358 - suspension of fundamental rights under Art 19 (FR)

Art 359 - FR under Art 2), 20 others cannot be suspended (other all F.R.suspended)
