While National Green Tribunal (NGT) has made immense contribution to protection of environment, various structural and functional issues have limited its effectiveness. Comment.

Main Body

The National Green Tribunal was set up as a quasi-judicial body to deal with environmental matters under National Green Tribunal Act, 2010.

NGT made immense contribution to protection of environment through:

Ordering curtailing pollution due to stubble burning
Imposing fine on industries releasing unleashed waste to Yamuna River
Ordering mass afforestation drive in public land.

However, it faces certain issues which limit its effectiveness:

Structural Issues:

1Vacancies : suffer from judicial and technical member vacancies
2Lack of Infrastructure - building, computers, internet
3High pendency of cases

Functional Issues:

1Conflict of Interest : Constituted under Energy at Environment and takes decision on policies concerning it.
2Overburdened : with responsibilities over Biological Diversity Act, 2003 among other legislation

The way forward [lay in filling up vacancies, infrastructure up-gradation, digital connectivity, to empower NGT.
