Both the USA and Indian constitution reats on a fine balance of separation of powers, yet certain differences in digitale and manifestation remain. Difference in separation of power: India - 1) Harmonious integration of executive and legislature. 2) separation of power is balanced by functional integration. E.g. Executive & legislature perform judicial functions & vice versa. USA - 1) Rigid separation of legislative and executive. 2) Strict separation of power with no overlap of functions.

3Judiciary's power are limited, wc-a-vc review and activism. 4) Also referred to as 'separation of functions'. Advantages of check & balances: 1) Ensures constitutional supremacy. 2) Does not allow for concentration of power in hands of any one using eg: USA → judicial supremacy. 3) Ensures stability and complementarity of functions. Eg legislature & executive decide appointment of judges, judiciary can review laws & button govt. 4) Avoids conflict and abuse of authority. Eg: over-centralised presidential powers in USA. Therefore, India's constitution makes realised the concept of India's seperation of power, invoking rule of law and constitutionalism.
