Main Body

Article 239AA: As per this article, the administrative matters of Delhi except for land police and law, are controlled by Delhi government. The exceptional subjects will be looked after by Lieutenant - Governor appointed by central government.

Dual-Governance Dilemma:

1Control over civil servants
As per SC verdict in 2025, the control over civil services in Delhi should be with elected state govt, but as per presidential ordinance, it rests with Lt.conflict over administration.
2Matter of municipality elections → always in elections due to vague understanding of power distribution.
3Control over land & police → weapon under its to usurp the power of democratically elected govt.
4legislations on treble over approval of bills by Delhi Lg. Impact on cooperative federalism
1Strained relations between state and central government → encroachment of constitutionally mandated power distribution.
2Lack of cohesive policy making for national capital.
3Issues related to financial distribution of power.
4Delays in passing of bills → breakdown of constitutional machinery in the state.

Therefore, there is an urgency to implement the Supreme Court verdict operation between Delhi LG & Lt. and vertical power sharing arrangement between union and state governments.
