When a Proclamation of Emergency is in operation, the right to move a Court for the enforcement of all Fundamental Rights remains suspended, except
- AArticle 20 and Article 21
- BArticle 21 and Article 22
- CArticle 19 and Article 20
- DArticle 15 and Article 16
Explanation
Under Article 359, when a Proclamation of Emergency is in operation, the President may suspend the right to move a court for the enforcement of the Fundamental Rights. The 44th Amendment Act of 1978, however, provided that this suspension cannot extend to the enforcement of the rights guaranteed by Articles 20 and 21. The protection against ex post facto laws, double jeopardy and self-incrimination (Article 20) and the right to life and personal liberty (Article 21) thus remain enforceable even during an Emergency. No other pair of articles enjoys this protection. Hence option A is correct.
