General KnowledgeIndian Polity and Governance
- Avoluntarily gives up his / her membership of the political party from which he / she was elected
- Bis expelled by the political party from which he / she had been elected to the House
- Cjoins a political party after being elected as an independent candidate
- Dabstains from voting contrary to the direction by his / her political party
Explanation
Under the Tenth Schedule, a member is disqualified for voluntarily giving up party membership, voting or abstaining contrary to the party whip, or joining another party after election as an independent. However, where the member is expelled by the party, courts have held this does not amount to 'voluntarily' giving up membership (the G. Viswanathan line of decisions), so no disqualification is incurred. The member therefore does NOT become disqualified in case (B).
